Hi guys. I haven't been an active user since the original Evthreads closed down, but I guess I need your opinion. I came across to the new BMTH song called "nihilist blues" and if you listen right after the beginning or after 3:00 to be more precise, you can hear that they totally ripped the verse of Never Go Back. My question is, is this considered as a copyright issue? Should we let Amy and guys about what's going on or do they know already? I'm quite confused here. Modern music is often based around four chords. As someone on Twitter mentioned, it kind of easy to create a similar melody when you have the same chords. (For example, I think the chorus of Hilary Duff's "Sparks" sounds a lot like Rihanna's "Only Girl in the World.") So personally, I'm not bothered. The song as a whole sounds totally different from Never Go Back imo. But that's just my take.

I'd suggest that you tweet it to both bands and see what their take is??? Is there any talk among fans of both bands on the socials about this yet at all? Edit: I just reweeted a comparison video to both bands for funsies, link here if you'd like to retweet for yourself etc. I'm curious to hear a response from Amy and the guys (I am assuming we won't get one though 😉)

It's unique to Evanescence. Unless Evanescence are a role model/influence to BMTH, I can understand. However, it seems like BMTH have just transposed it. The song would obviously sound different because it's two different groups using different instruments/style etc. The underlying melody of the verses are the same! youtu.be/Ex54pCrpoIYSomeone's already done a mashup, interesting. Amy's voice has been transposed to match the key of the song.

The songs also sound different because literally every part has a different melody except the 2 verses, which (combined) time out to about a minute out of five and a half minutes. I highly doubt Amy is going to care, kind of like how Paramore doesn't seem to care that Godsmack has a nearly identical guitar solo as Decode in one of their new songs.

That does sound eerily similar. I don't want to say it's been copied or stolen but it does sound too much to be a coincidence. But maybe the sampled it or otherwise asked Ev if they could use it?

I think it sounds quite similar as well, maybe even too much to be coincidental. Guess we'll just have to see if Ev themselves have a problem with it.

There's definitely a noticeable similarity and I feel like they must have been either consciously or unconsciously inspired by NGB (I've definitely written music before thinking it's original only to hear an older piece of music and suddenly realise it must have wormed its way into my head somehow). As for copyright infringement, I'd be incredibly surprised if there's a case for this. Unless it's directly sampling another artist's work, I'm pretty sure you can do what you want.
It would be interesting to know whether or not Kid Rock had to pay royalties to Warren Zevon and Lynyrd Skynyrd for "All Summer Long". That's the most obvious example I can think of for 'borrowing' another artist's melody.

I'm not a professional musician, but I play guitar and piano and I know music theory well enough to know that that's more than just a usage of the same chord progression. It's obvious that there's an influencing involved which might be flattering for Ev if they made us know that this song is an homage or they were inspired by the song. That was the reason I wanted to know if the band or you guys know anything about the issue which apparently Amy or the guys are unaware. Other than that, I don't think there would be any solid copyright issue legally.

There are definitely blatant similarities, but I don't know how much would be plagiarizing. I think there is a term for that, not sampling. But I remember in 4th grade our teacher made us pick a song and write our own lyrics to it with the same melody. Not sure, I was a kid. I do remember instances similar to this, though. People say The Birthday Massacre's Superstition reminds them of Girls Just Wanna Have Fun. There is also an up and coming band called Girls Named Jennifer whose song Summertime Blues is eerily similar to the chorus of Local H's Bound to the Floor.

So mystery solved.... I was looking up Terry Balsamo and this came up.... ![]()  Looks like BMTH did take the melody of NGB.
