As we all know, Evanescence are no longer with Wind-Up anymore. For those of you who do not know, or are new fans (WELCOME TO EVTHREADS!), Evanescence was signed to Wind-Up from 2001 to 2013. Wind-Up sold their back catalog and future catalog (of many of their bands) to Concord Music Group and Bicycle Music Company (they are "sister", or associated, companies). This includes Evanescence. The_Sacrificed is correct. In October, Wind-Up sold the "back" catalog of most "older" bands/artists to Bicycle and Concord. It states in the press release, that Bicycle and Concord have the distribution rights to all past and future master recordings of the artists they bought. I think this means that when Ev put out new music again, Ev will go through Concord or Bicycle (most likely Bicycle as previous albums are now under Bicycle on Rhapsody - I haven't had a thought to check somewhere else until now *facepalm*) to distribute the new material. As for the Lillywhite Sessions, I'm unsure if they moved. If they were mastered then they probably did move. If they are still in demo form, then Wind-Up probably still has them. However, we do not know the terms and conditions of the agreement of neither the Wind-Up lawsuit finalizing nor the terms and conditions of the agreement of Bicycle/Concord.

But I'm confused, coz Amy tweeted that when she wants to put something out she just will, that implies to me that she can and could drop material to us online or that she has the freedom to, how does that mesh with their "future material" to be released by Bicycle?

This. That's been confusing me too. I would have thought that if her contract with Wind-Up has been terminated, that would terminate any future dealings with Bicycle and whatnot. Obviously their past work will still belong to them, but perhaps not future recordings? Or maybe if Bicycle do still have access to future recordings, they don't actually have any say on when, where or why they are released, they just have access to them and can do what they want with them also?

I mean Bicycle obtained all the rights to Wind-up's catalog so if Amy says that she is an independent artist wouldn't that mean that she wouldn't be on Bicycle’s roster? I am guessing that the lawsuit with Wind-up ended with Amy being successful so now she is free of a label…therefore not with Wind-Up or Bicycle. That’s my understanding.

I don't think that Amy has to answer to Bicycle or Concord or anyone, but that they'll be handling the catalog at her command. Maybe.
I do think that perhaps we should have a different thread to discuss this, however.

Thank you for the information. The Lillywhite Sessions were not something I was always aware of, until recently that is. I am still unsure of what exactly they are, though I do have an idea. I believe them to be the demo songs recorded for the "Evanescence" album released in 2011. If I am wrong on that, just let me know! My only fear for Evanescence, would be the fact that Wind-up has the rights to their songs and lyrics. Meaning, without consent that any other band could cover one of their songs and change whatever they like as long as Wind-Up approves it. You know what I mean? I am probably taking it too seriously, I just feel protective over their music, as do so many others.

Everything Ev/Amy recorded under Windup goes to Bicycle. This probably includes the unreleased LillyWhite sessions (which counts as future material, since it is unreleased). Anything and everything they went to the studio to record is owned by the label. But everything that is written and recorded, from now on, is owned by Amy. So probably not push the button or even find a way, if those were written and recorded under the label. But anything she has on her laptop that she hasn't brought to the studio, we will probably get whenever she wants us to get it. That's how I understand it.

Well, I don't think this is the right thread to bring it up, but I don't think they were demos as the album was set to be released in the Fall. I think they were the final work.
I hope they will get released eventually.

This is all just speculations since no one really knows the detail of the deal anyway.
Regarding the master recordings, Amy or any artists for that matter don't own the master recordings, so they don't really have a say to it unless they buy them. So Wind Up can do whatever they want with it, like make a Greatest Hits album (which could happen soon) or something.
EDIT: Flatus flatus, that's how I understand it too...

I'd really like to know if the "legal issues" that prevented Amy from releasing the Lillywhite sessions material in 2010/2011 have been resolved by this lawsuit?

This is so great. Seems like the news always comes up when I am gone though. I'm hoping Amy is hinting at dropping something soon. A 4 or 5 track EP would be awesome, but even one song would be great too. She probably can't do it too soon, or the label might think that those songs were done while she was still with them
